MONTREAL—It has been said that Stephen Harper is his own best strategist: a master tactician liable to be a few moves ahead of his opponents.

And in the past, the Prime Minister has often lived up to that reputation.

But how many chess games can he actually play at the same time? As of now, there are three simultaneous ones underway, each involving the ruling Conservatives and one of the opposition parties in the House of Commons.

On the first set, where the action has been for the best part of the year, the Liberals and the Conservatives have played themselves out. For the past nine months, Harper held the advantage, advancing his policies as he saw fit while the Liberals tried, in vain, to finesse their way out of a tight corner without risking too many big pieces.

This week Liberal Leader Michael Ignatieff basically overturned the board and left the table. The next decisive play between him and Harper will take place in an election campaign.

Still, the Prime Minister figures he can score one last hit on Ignatieff before they carry their battle on to the next stage, by forcing the Liberals to bring the popular home renovation tax credit down with the government when the House returns in 10 days.

It may surprise many Canadians to find that a program they have been encouraged to spend significant amounts of money to qualify for has not yet been submitted to Parliament for approval.

It seems the Conservatives held it back for a moment such as this.

But if the Prime Minister wants to use the home renovation credit to embarrass Ignatieff, he will have to find a way around Gilles Duceppe.

Yesterday, the Bloc Québécois leader told Radio-Canada that if the government brings forward a supply motion to finance the home renovation program later this month, his party will support it.

Unless Harper loads a budget-related motion with other items that are unpalatable to the Bloc, the tax credit will sail through the Commons.

Jack Layton spent the past four years keeping a tab of every Liberal move that was supportive of the Conservatives. Only two weeks ago, he was quoting irreconcilable differences with Harper and arguing the NDP was the least likely to ever find common ground with the government. But yesterday he insisted there were moves that could actually bring the two so close that they could, together, keep Parliament going at least until the end of the year.

Since last fall's failed coalition attempt, Harper has made a virtue of not associating with Layton or Duceppe. Accusing the Liberals of catering to socialists and separatists to achieve power is part of this year's Conservative election playbook.

For his part, Layton has spent the past four years positioning his party as the only real opposition to the Conservatives. Since the last election, both he and Duceppe have systematically voted against the government on matters of confidence.

Given a choice, Harper sounds like he would rather see his government defeated than depend on the Bloc or the NDP for its survival. And Duceppe and Layton's core supporters really have zero tolerance for a prolonged cooperative spell between their parties and the Conservatives.

Notwithstanding the public assertions of the leaders, the current manoeuvres have more to do with establishing their respective places around the deathbed of the minority Parliament than with significantly extending its life.

OTTAWA–Canadians are getting a sneak peek at an election campaign that hasn't yet started.

Players brought out props for a bit of political theatre yesterday: Human Resources Minister Diane Finley showed empty chairs to cameras to paint the Liberals as no-shows for a meeting on EI reform.

On other stages, there was political posturing.

Prime Minister Stephen Harper, in Niagara-on-the-Lake, declared he'd make "no backroom deals" to save his government. He painted his opponents as the same devilish dealmakers from last year's unpopular coalition again out to reverse the results of the past election. Yet he welcomed any "good, effective, affordable ideas" from his critics.

NDP Leader Jack Layton and Bloc Québécois Leader Gilles Duceppe have offered a political lifeline to Harper: their support on confidence votes if their demands are met.

Layton, at a news conference in Halifax, stressed the New Democrats would prefer action to an election: "The ball is entirely in Stephen Harper's court."

More than anything, however, there was a lot of political positioning. Just in case an election cannot be averted.

On the heels of Liberal Leader Michael Ignatieff's threat to vote out the government as soon as possible, the parties have shifted into pre-election mode.

In the 308-seat House of Commons, the Conservatives hold 143 seats, the Liberals 77, the Bloc 48 and the NDP 36. (There is one independent MP and there are three vacancies.)

To trigger an election, all three opposition parties would have to vote to defeat the government.

The NDP and Bloc, who have long promised to overturn the government, are at pains to appear conciliatory, not combative, more interested in making Parliament work than they expressed in the past 10 months.

Layton said he wants to see "concrete action" on three key issues his party has pushed for this year – enhanced employment insurance benefits, pension protection and reduced credit card and ATM fees.

He would not specify what he would need from Harper in exchange for supporting his government through crucial votes in the coming weeks.

Duceppe let it be known he would support the government on an early ways-and-means motion to implement the budget's home renovation tax credit, if that's all it contains.

Liberal MP Bob Rae emerged to counter an early salvo of the Conservatives – that the home renovation tax credit would be killed if the government is defeated.

It's here to stay no matter who is in power when it is time to file tax returns next year, Rae told reporters: "Carry on painting. Carry on renovating. Those tax credits will be fully recognized."

Harper, continuing a week of spending announcements, cast himself as the only leader who cares a whit about the economy.

He announced new money for border crossings and bridges in the Sarnia and Niagara regions, insisting the bricks-and-mortar spending was more than just short-term job creation projects.

"It is more fundamentally about where we are headed as a country," Harper said. Upgraded infrastructure will "lay the groundwork for Canada's long-term future economic prosperity," he said, adding an election now could derail a fragile recovery.

HALIFAX–Canada's ethics commissioner fined Defence Minister Peter MacKay $200 yesterday for failing to disclose his involvement as a director and officer of two companies owned by his father.

MacKay resigned from Beaver Lumber Co. Ltd. and Lorne Resources Co. Ltd. this week after the commissioner contacted him.

The Conflict of Interest Act forbids cabinet ministers from serving as officers in corporations.

MacKay said the mistake was inadvertent.

"There's no formal role that I ever played, and so I simply forgot essentially that my name was still showing on the roll," he said. "I'm sorry about this oversight."

OTTAWA–Maxime Bernier may be gone from the federal cabinet, but the controversy that ousted him from the lofty foreign affairs post a year ago is not forgotten.

Weeks of political nightmare for Prime Minister Stephen Harper's government in 2008 were resurrected yesterday with accusations in the Quebec newspaper Le Devoir that the secret documents he mistakenly left at a former girlfriend's apartment contained "crucial intelligence for (Canada's) enemies."

The 560 pages of material to prepare Bernier for the April, 2008 NATO summit included Canada's stance on the treatment of Taliban prisoners in Afghanistan, missile defence, the presence of Al Qaeda in Pakistan, Iran's nuclear ambitions, the Dalai Lama and arms control in the Middle East.

It was, noted Le Devoir, a treasure trove of sensitive information that included details of what Bernier planned to discuss with his foreign counterparts. Much of the material, obtained under the Access to Information Act, was blacked out by government censors.

Bernier resigned on May 26, 2008 after Julie Couillard returned the material to the federal government. The Montreal real estate agent had been married to and dated men connected to Quebec's biker gangs.

Bernier condemned the article yesterday. "The journalist grounds his assertion not on the nature of the information itself – which he has not seen – but on the fact that the word `Secret' is marked on sections of the documents ... and the fact that paragraphs were taken out by civil servants before he obtained the document, which was totally predictable since we're talking about secret documents," he wrote on his personal website.

Saad Khalid was only 16 when he was dealt a devastating blow.

He returned home to find paramedics trying to revive his mother, who had been found submerged in the bathtub. He sank to his knees in despair and buried his face in his hands. She was gone.

The once-gregarious teen became reticent. He withdrew from sports, tended to his younger siblings and took on more household chores.

He and his brothers and sisters were discouraged from speaking about his mother's struggles with depression and her death. Instead, they were told to pray to God.

Khalid, whose family was Muslim but not overly religious, found comfort in Islam. At his Mississauga high school, he started hanging around Muslim students with extremist views, denouncing the West and leading impassioned sermons about jihad and martyrdom.

Reflecting on those years, Khalid would later tell a psychiatrist that he had developed a "connection toward the Muslim cause" and an "increased sense of meaning." He believed he was "here for a purpose." By age 19, he felt a religious obligation to do something to change Western policies that he believed were hurting Muslims.

Yesterday, Khalid, now 23, was sentenced to 14 years for his role in a homegrown terror cell known as the Toronto 18, which was busted in June 2006 for plotting to detonate truck bombs in downtown Toronto.

But he was given credit for his three years and three months spent in pre-trial custody, meaning his sentence amounts to an additional seven years behind bars. He will be eligible for parole in 28 months. Khalid was ordered to provide a DNA sample and was given a lifetime weapons prohibition.

In May, he pleaded guilty to intending to cause an explosion that was likely to cause serious bodily harm, death or damage to property. He was the first member of the group to admit the existence of a bomb plot.

His sentence will surely influence some of his co-accused, who are also considering guilty pleas.

Superior Court Justice Bruce Durno told a Brampton court yesterday he had been persuaded Khalid did not know all the details of the chilling plot and that he had expressed regret for his involvement.

While reading from the 48-page ruling, the judge also noted Khalid "was vulnerable after the death of his mother and recruited by more devoted extremists."

"(Khalid's) need to emulate powerful and influential leaders, combined with his youthful naivete, were evident and likely played a role in his behaviour," said Durno.

Khalid was arrested while unloading three tonnes of ammonium nitrate fertilizer intended to blow up the Toronto Stock Exchange, the Front St. offices of Canada's spy agency and a military base off Highway 401. The plot was foiled with the help of undercover police agent Shaher Elsohemy, who set up a sting operation that resulted in the arrests of 14 adults and four youths.

The story of how Khalid went from being a carefree child to convicted terrorist emerges, in part, from Star interviews with former schoolmates and court documents, including a psychiatric report and about 30 letters from Khalid's family and friends to the judge.

Khalid was born in Saudi Arabia to Pakistani parents and is the middle of five children. The family moved to Canada in 1995, when he was 9.

By all accounts, he was an average kid, raised by supportive parents. He loved cartoons, video games and playing sports, especially soccer and cricket.

By Grade 9, he wanted in with the cool crowd, he told forensic psychiatrist Dr. Lisa Ramshaw during a risk assessment that consisted of two interviews done in the spring.

Initially, he didn't have many Muslim friends, preferring to hang with the "cool black guys," who were popular with girls, and he began skipping class and getting into fights. But even during those early years in high school, Khalid respected his teachers and never disobeyed his parents.

His mother's death marked a turning point for him, family members say.

"(Khalid) was at a stage in his life when he was preparing to achieve a lot of good things," wrote his father, Khalid Syed, who works in information technology. "The untimely loss of his mother came as a great shock and disrupted his life."

One of Khalid's uncles said the loss "skewed (Khalid's) psychological state of mind in a manner that we failed to identify" and that the "psychological trauma" led to his involvement with the group.

His family didn't realize he had an increasing preoccupation with the Muslim cause.

But at Meadowvale Secondary School there was no mistaking it. He made new Muslim friends, including the alleged mastermind of the bomb plot, started praying five times a day, and began leading sermons that made him popular.

He criticized western policies and Canada's role in Afghanistan, turning sermons into vitriolic diatribes about how the West was the enemy.

A former student who attended sermons led by Khalid and a co-accused told the Star he remembered being pressed about what he planned to do for his Muslim brothers overseas.

"They spoke about martyrdom at the sermon, how martyrs would go straight to heaven," said the young man, who asked not to be identified.

By the time Khalid started at the University of Toronto, where he studied business management, he felt obliged to do something. Months later, in December 2005, he and other members of the Toronto 18 attended a terrorist training camp, held in Washago, Ont. The bomb plot began to take form in March 2006.

During his interviews with Ramshaw, he denied any change in his religious convictions or political beliefs, but said he now realized there were other ways to effect change.

There was "no tangible benefit from fighting," he said, adding that he would like to channel his energy and "do more grassroots work."

The Canadian Criminal Code is tough on hate-mongers, and rightly so. It provides for up to two years in jail for wilfully promoting hatred against identifiable groups. That's a major deterrent to racists, homophobes and other purveyors of hate in the media or anywhere else.

Given this safeguard, it's hard to see why the Canadian Human Rights Commission (CHRC) should also be empowered to impose fines of up to $10,000 and award damages of up to $20,000 for much the same offence, under a controversial section of the human rights act that prohibits telecommunicating "any matter that is likely to expose a person or persons to hatred or contempt."

Critics of Section 13(1), including the Star, regard it as an unwarranted chill on our Charter right to freedom of thought, belief, opinion and expression that imperils spirited public discourse.

Now, surprisingly, a member of the CHRC tribunal agrees.

In a bombshell ruling this week, Athanasios Hadjis flatly challenged Section 13's constitutionality. He found that a Canadian with neo-Nazi ties ran afoul of the rights act by posting an anti-gay message on his website. But Hadjis also found Section 13 to be unlawful because it is more than a "minimal" infringement on freedom of expression.

That contradicts a 1990 Supreme Court ruling that upheld Section 13. But Hadjis argues that back in 1990 the CHRC could only issue a "cease and desist" order, not impose punitive fines. That changed in 1998. "The potential `chill' upon free expression may have consequently increased," he reasons.

This ruling strengthens the case for Parliament to get the CHRC out of the business of policing hate speech by repealing Section 13 and leaving the problem of hate speech to the criminal courts.

Section 13 isn't salvageable. It can be interpreted to cover stereotyping and defaming, as well as hate-mongering. There's no need to prove intent. The tribunal can accept evidence that wouldn't stand up in court. And it doesn't have to establish guilt beyond doubt. It's that bad.

Even the CHRC now agrees that Parliament must more clearly define what constitutes hatred and that the CHRC should lose the power to fine. Yet it wants to continue sitting in judgment on these issues.

Why? An open, democratic society should impose as few restrictions as possible on free speech. Hate crimes should be handled by the courts, not by lesser tribunals.

Freedom of speech is the lifeblood of all constitutional democracies. Without it, democracy readily becomes tyranny of the majority or – even more likely – of the most politically powerful minority. Yet freedom of speech also has limits.

Political scientists from Canada and the United States are meeting in Toronto for the annual convention of the American Political Science Association (APSA) this weekend. In response to a petition we received earlier this year – on whether Canadian law on "hate speech" and Human Rights Commissions posed a threat to freedom of speech and academic freedom – we are debating the question from perspectives on both sides of the issue, and both sides of the border.

Although Canada and the United States are close-knit constitutional democracies, their limits on free speech differ, especially in the treatment of hate speech. Both provide broad protections of free speech, but the Criminal Code of Canada includes legal penalties against "the wilful promotion of hatred" while U.S. law does not. While meeting in Toronto and pursuing the free exchange of ideas about democratic politics, we thought it fitting to wrestle anew with the question: How free should hate speech be? Comments by professors Keith Whittington, Carissima Mathen, Jeremy Waldron and Robert Post follow:

We are rightfully wary of using governments to regulate speech. It is one possible response, the last available response, and often a response that brings its own share of problems. Legal regulation is often motivated by the extreme case, the obvious case. But once the regulation is in place, it will not be easily limited to the extreme case.

Not long after the adoption of the U.S. Constitution, Congress passed the first federal sedition law, making it a crime to cause "hatred" against the government. In response, the critics of the government, led by Thomas Jefferson, developed new ideas about the role of free speech in a democracy. As they pointed out, and frequently found out, government prosecutors and partisan juries were all too willing to believe that expressing an unpopular opinion in strong terms about the incumbent president was not robust political speech but rather illegitimate hate speech.

Hate speech makes most people recoil, yet in choosing to deal with it through the criminal law we run the risks of being both over-inclusive and ineffective. It can be exceptionally difficult to decide whether a particular expression embodies "hate" as opposed to other strong emotions, such as passion or anger, that have a legitimate place in public debate. In a society marked by diverse groups with different conceptions of the good, we should be especially wary that such laws will be used against those who hold odd or unorthodox beliefs, or are simply slower to accept new social norms. Canada criminalizes hate speech on the basis that it contributes nothing to our society and harms the groups that it targets. If the harm can be addressed through non-criminal means, then resorting to the criminal law is inappropriate. Procedural safeguards do not mitigate the risks posed by a vague and indeterminate law. There is a place for intervention to deal with material that actively subverts rather than enhances public policy, a threshold that our society is entitled to determine. But such intervention ought to be primarily directed at the materials, not the speaker. In the absence of a specific risk of violence or advocacy of unlawful behaviour, hate speech should not be criminalized.

Certainly, racist hate speech should be restricted in some circumstances. The publications we call hate speech are often intended to do two things: (1) to defame and attack the dignity, honour and social standing of minorities and their members; and (2) to undermine the assurance that any good society is trying to give to its most vulnerable citizens that they and their families can go about their lives with some basic security against humiliation, discrimination and violence. Perhaps a society with no history of racial, ethnic or religious tension can afford to ignore this. But in the real world, such expressions of hate function as reminders that what has happened in the past might happen again – reminders that are heard differently by members of vulnerable minorities than by members of the secure majority. Dignity and assurance for all are fragile and vulnerable achievements, and well-drafted laws against hate speech, if they are administered carefully through the courts by an attorney general (or by prosecutors who bear proper responsibility for preserving public order), can play an important role in upholding them.

All societies regulate uncivil speech regarded as inconsistent with the prerequisites of social solidarity. One question is who is authorized to define such speech. Countries with strong, coherent elites, like Iran or Saudi Arabia, unilaterally define uncivil speech in terms of the ideology of these elites. Self-consciously multicultural societies, like Canada, India or Australia, must also rely on powerful centralized elites to define the rules by which diverse groups shall be permitted to deal with each other. In societies like the United States, in which such elites are weak or fractured, authority to define uncivil speech is correspondingly reduced. A second important variable in the comparative regulation of hate speech is the need for free and undisciplined participation in public discourse in order to secure democratic legitimation among heterogeneous populations. The stronger this need, the more the regulation of hate speech will be reduced. Finally, some states affirm social solidarity based upon the "levelling up" of all citizens to the norms of honour previously associated with aristocratic elites, whereas other societies, like the United States, affirm social solidarity based upon a "levelling down" to mass proletariat manners. The regulation of hate speech is much less urgent in the later circumstances.

Out-of-province judge may be needed for Bryant case

TORONTO - The sudden twist of fate that left Michael Bryant facing criminal charges in the death of a bicycle courier has also thrust Ontario into a legal quandary: How do you put a former attorney general on trial?

Bryant, who once appointed judges and oversaw Crown prosecutors, has suddenly found himself on the opposite side of the judicial system, accused of criminal negligence causing death and dangerous operation of a vehicle causing death.

The Ministry of the Attorney General, which administers justice in the province, is treading carefully to avoid any whiff of political interference.

It's hired top Vancouver criminal lawyer Richard Peck to prosecute the case and isolated the bureaucrats who are overseeing the process from Bryant's former Liberal colleagues, like current Attorney General Chris Bentley.

One expert predicts an out-of-province judge will also be recruited to preside over Bryant's case, which made headlines across the country.

"No one for a minute would suggest that a provincial court judge would actually be biased in his favour," said Toronto defence lawyer Jonathan Rosenthal.

"But it certainly would have the apprehension that she would be biased, that she would not be independent, and that's why they'll bring in a judge from another province."

The choice of judge ultimately lies with Chief Justice Annemarie Bonkalo of the Ontario Court of Justice, who was appointed by Bryant in 2007.

He also appointed associate chief justices Peter Griffiths and John Payne.

Sylvia Gudzowski, Bonkalo's assistant, said the matter is "currently under consideration," but declined further comment.

The high-profile case has already raised questions about whether Bryant - who was released from police custody Tuesday without appearing before a judge - received preferential treatment.

After spending the night in police custody, a clean-shaven Bryant emerged to face the cameras dressed in a dark suit that had been delivered to the station.

But it would have been "almost impossible" to get a timely bail hearing for Bryant, which would have required an out-of-province judge and a prosecutor to avoid any potential conflict of interest, said Rosenthal.

"I wouldn't say it was preferential treatment, I would say it's different treatment," he said.

"Let's face it, it's probably the first time that the police ever arrested the attorney general from the province."

Bryant is to make his first court appearance on Oct. 19.

Different and sometimes conflicting accounts of the events leading up to the fatal encounter Monday night have emerged in the aftermath of Bryant's arrest.

Police say bike courier Darcy Allan Sheppard, 33, grabbed onto a car in Toronto's tony Yorkville district following an altercation with the driver.

The driver drove away with Sheppard hanging on. He then fell and suffered fatal injuries, police said.

According to sources, Bryant was driving home that night from an anniversary dinner with his wife, Susan Abramovitch.

Later that night, Bryant was photographed sitting in the back of a police cruiser. He was taken into custody by police and released the next day after the charges were laid.

Sheppard's girlfriend, Misty Bailey, said he was drunk when he showed up at her door earlier that night and that police refused to take Sheppard home.

But police, who say they were called to the apartment just minutes before his death and escorted him out, said Sheppard showed no signs of intoxication.

Sgt. Tim Burrows said police are investigating every angle, including the possibility that Sheppard may have grabbed the steering wheel of the car.

"We're looking at everything," he said.

There's a lot at stake for Bryant, 43, a Harvard-educated lawyer who was considered by many to have the right stuff for a run at the premier's job.

Criminal negligence causing death carries a maximum sentence of life in prison, while dangerous operation of a motor vehicle causing death carries a maximum 14-year term.

If convicted, Bryant could also face disciplinary action from the Law Society of Upper Canada.

Bryant, who spent 10 years at the provincial legislature before announcing he would step down in May, has maintained his innocence.

He hired Marie Henein, who worked with top defence lawyer Edward Greenspan, as his legal counsel Thursday. Henein defended former hockey coach David Frost, who was found not guilty of sexual exploitation last November.

Bryant has also retained the services of Toronto public-relations firm Navigator Ltd., which former prime minister Brian Mulroney employed during the Oliphant inquiry.

Law professor Douglas Sanderson, who worked as a senior policy adviser to Bryant between 2004 and 2008, said he hasn't talked to the former cabinet minister since the incident.

He described Bryant, a fellow Fulbright scholar, as an exceptional attorney general who tackled many lesser-known projects, such as human rights reform, as well as the headline-grabbers like his public crusade to ban pit bulls.

But Sanderson urged patience and caution for those gripped by the story and media frenzy surrounding the case.

"It's a tragedy by any standard," he said.

"New details are emerging daily and I think everyone should hold off judgment until we get a full set of facts."

OTTAWA–Maxime Bernier may be gone from the federal cabinet, but the controversy that ousted him from the lofty foreign affairs post a year ago is not forgotten.

Weeks of political nightmare for Prime Minister Stephen Harper's government in 2008 were resurrected yesterday with accusations in the Quebec newspaper Le Devoir that the secret documents he mistakenly left at a former girlfriend's apartment contained "crucial intelligence for (Canada's) enemies."

The 560 pages of material to prepare Bernier for the April, 2008 NATO summit included Canada's stance on the treatment of Taliban prisoners in Afghanistan, missile defence, the presence of Al Qaeda in Pakistan, Iran's nuclear ambitions, the Dalai Lama and arms control in the Middle East.

It was, noted Le Devoir, a treasure trove of sensitive information that included details of what Bernier planned to discuss with his foreign counterparts. Much of the material, obtained under the Access to Information Act, was blacked out by government censors.

Bernier resigned on May 26, 2008 after Julie Couillard returned the material to the federal government. The Montreal real estate agent had been married to and dated men connected to Quebec's biker gangs.

Bernier condemned the article yesterday. "The journalist grounds his assertion not on the nature of the information itself – which he has not seen – but on the fact that the word `Secret' is marked on sections of the documents ... and the fact that paragraphs were taken out by civil servants before he obtained the document, which was totally predictable since we're talking about secret documents," he wrote on his personal website.

Sclavie moderna, in Canada - vai de mama ei de drepturile omului pe aici...


Se pare ca la paritate cu Ciprian Nastasiu, asa-zisul procuror independent, dar se pare ofiter de informatii care l-a anchetat pe Omar Hayssam, a cazut in Canada Michael Bryant, fost procuror sef in Ontario, ceva in genul asta, baiat in politica, viitor politician Tory. Cred ca echipa din Toronto, implicata in acoperirea jocurilor cu actele mele, date se pare colegului si prietenului Simonei Furtuna, Iulius Nistor, au fost sau au preluat Tory din Ontario, nu prea inteleg de ce totusi... Probabil prin Iulius s-au negociat sau platit ceva comisioane - poate s-a exportat si de la SNC Lavalin, urmare fiind ca directorul francofon al CSIS si-a dat demisia, ca acoperire...
Curios, s-au cumparat din Quebec codurile de procedura penala si civila, poate la "facilitarea" fostului meu socru, jud. Ctin. Furtuna, si prin Catalin Predoiu, var indepartat al lui Silviu Predoiu, directorul adj. SIE. Sa fie cei trei "un aspect" al comunitatii de informatii rrome, de care face atat caz Corneliu Vadim Tudor? Poate ca din cauza asta este greu de inregistrat chiar in Canada divortul meu, poate ca din cauza asta imi tot sunt "vanturate" si fluturate intimidari, sugestii de trecere in aborigen, de persoana cu dizabilitati, poate ca asa s-au fabricat acuzatii de siguranta nationala, de agresiune conjugala...
Canada isi bate joc de cetateni, a inceput sa fie o frauda, si urgent este de plecat din jocul lor de "cover-up".
Cred ca actele mele pentru Nistor au fost gestionate de Furtuna-Berceanu, si au participat oarecum la afacerile Tigareta I-IV. Nu inteleg de unde apare legatura cu Hong Kong-ul, dar este posibil ca jud. Furtuna sa fi facut protectia informativa si pentru dosarele Nastase, cu conexiunile lor chinezesti....
Din pacate, m-au prins la mijloc, m-au fabricat drept un "terorist" si sunt folosit pe post de momeala vie, live-bait, ca si alti detinuti Guantanamo, gen Maher Arar. Sunt lipsit de acces juridic, iar in rest, imi sunt aruncate pe toate ziarele gratis sugestii de HIV-SIDA. Posibil ca gen. Gordon Diamond, probabil initiatorul furtului de acte al meu, este cel care a pus la cale jocul. Sunt nevoit sa numar cel putin 3 politicieni tineri, care au iesit din joc, din cauza situatiei Bulacu-Nistor...
Initial am crezut ca Miron, fratele meu este folosit drept inlocuitor al meu, dar constat ca nu. Am crezut la un moment dat ca Valentin ?Lance?, actualul sot-prieten al fostei sotii este inlocuitorul meu, iar gasca SPP-SIE-PSD din jurul dr. Oprescu, fiul unui gen. DSS incearca sa rezolve cumva o izolare-detentie a mea, sub diverse pretexte sau mijloace, doar ca sa acopere un "rahat" major al gastii Iliescu, si "bavuri" ale serviciilor de informatii NATO, gen Madrid 3/11.
Aparent, prin jocul asta, se urmareste destabilizarea UE pentru SUA, ca o operatiune de informatii Foreign Flag, desfasurata de Canada-Israel-Romania. Aparent din cauza asta a ajuns echipa de ziaristi din Iraq in portbagaj, iar aici, in Toronto, se urmareste exact un "portbagaj" pentru mine. Cum au ajuns oare romanii sa faca jocurile astea de destabilizare pentru altii, ei fiind cei care vor lua rahatul, nu pot intelege. Cert este ca in acest moment, Canada nu mai este deloc ceea ce a fost, este o tara relativ periculoasa pentru intimitate, pentru cariera, ne-prielnica... Imi pare rau sa o spun, poate ca eu am de-a face de fapt doar cu un regim "micro" al CIA in Toronto, nu stiu precis. Poate ca este exact aceeasi situatie ca in Craiova, unde sub pretextul Ford se trag tunuri si se fac jocuri informative...
Este foarte posibil ca "account-ul" Mihai Bulacu sa fi fost cumva in portofoliul firmei IMP, din Halifax, de unde, coincidenta, actualul ministru canadian al apararii, Peter MacKay este. La Bombardier DSD l-am avut coleg pe fiul unui alt col. de la IMP, si poate ca nu a fost o coincidenta, ci era deja in contul "acte pentru Iulius Nistor, Chris Koening.
Sa fi facut canadienii Madrid 3/11, sa fi fost atat de nebuni incat sa marseze pe astfel de cretinisme?

In jocul asta, in Canada au incercat sa ma bage pe scenariul col. KGB-FSB Mihail Lenninkov, un individ care urmeaza sa fie deportat din Vancouver. Ma intreb daca intre jud. Furtuna, av. Victor Ciobanu si Adrian Goldenberg, operator de taxi la New York, confectioner de lenjerie in lohn in Romania exista vre-o legatura, sau este vorba doar despre o mica "coada" a WTC 9/11 2001. Grig Carstea, fostul meu coleg de facultate a fost in NY exact in 9/11 2001, iar Motorola shell al lui de atunci, l-am avut pentru o perioada si eu... Sa fie o coincidenta, sau este o operatiune informativa? In ce echipa e Furtuna? Victor Ciobanu este ofiter de informatii DSS, acum avocat...

Se joaca tare orice legaturi si “propuneri” de siguranta nationala, pentru a acoperi orice ancheta si a sterge urmele. Vad ca Tory canadieni, partenerii PDL-ului si SPP-ului in afacerile Tigareta I-IV, Bricheta, Valiza cu Bani, MetroRex Bombardier fac orice, totul posibil in a ma lichida in Toronto… Sper sa reusesc sa scap din “raiul” canadian, rai care-i adaposteste cu brio pe epileptici gen Florin Picu, “sursa” din Bechet, da identitati false unor surse gen Vasile Nita, si exceleaza in Romania in “unlawful police entry”, in “illegal internet interceptation – RomTelecom ADSL”, si mai ales in “post-fabricated evidence and charges”. Din pacate, m-au prins la mijloc, m-au fabricat drept un "terorist" si sunt folosit pe post de momeala vie, live-bait, ca si alti detinuti Guantanamo, gen Maher Arar. Sunt lipsit de acces juridic, iar in rest, imi sunt aruncate pe toate ziarele gratis sugestii de HIV-SIDA. Posibil ca gen. Gordon Diamond, probabil initiatorul furtului de acte al meu, este cel care a pus la cale jocul. Sunt nevoit sa numar cel putin 3 politicieni tineri, care au iesit din joc, din cauza situatiei Bulacu-Nistor...
Initial am crezut ca Miron, fratele meu este folosit drept inlocuitor al meu, dar constat ca nu. Am crezut la un moment dat ca Valentin ?Lance?, actualul sot-prieten al fostei sotii este inlocuitorul meu, iar gasca SPP-SIE-PSD din jurul dr. Oprescu, fiul unui gen. DSS incearca sa rezolve cumva o izolare-detentie a mea, sub diverse pretexte sau mijloace, doar ca sa acopere un "rahat" major al gastii Iliescu, si "bavuri" ale serviciilor de informatii NATO, gen Madrid 3/11.
Aparent, prin jocul asta, se urmareste destabilizarea UE pentru SUA, ca o operatiune de informatii Foreign Flag, desfasurata de Canada-Israel-Romania. Aparent din cauza asta a ajuns echipa de ziaristi din Iraq in portbagaj, iar aici, in Toronto, se urmareste exact un "portbagaj" pentru mine. Cum au ajuns oare romanii sa faca jocurile astea de destabilizare pentru altii, ei fiind cei care vor lua rahatul, nu pot intelege. Cert este ca in acest moment, Canada nu mai este deloc ceea ce a fost, este o tara relativ periculoasa pentru intimitate, pentru cariera, ne-prielnica... Imi pare rau sa o spun, poate ca eu am de-a face de fapt doar cu un regim "micro" al CIA in Toronto, nu stiu precis. In Ghost Plane - The True Story of The CIA Torture Program de Stephen Grey, la pag. 52 citesc urmatoarele: "They wanted to connect him with almost every possible person supposed to be of importance "in Al Qaeda".". Am impresia ca jocul asta a fost facut in Romania de echipa din care face parte col. Bica, dr. Boiangiu, si poate si fostul socru, dar am totusi indoieli. Din ce am inteles pe undeva, jud. Furtuna a avut un regim de semi-suspendare pana prin martie 2008, nu stiu motivele.
Cred ca Simona Furtuna, fosta sotie, in sept. 2006 in vizita ei posibila la ONU - New York - in perioada unui summit pe probleme de terorism, a fost supusa probabil pe principiul acesta de "legare", in capitolul despre ing. Canadian wireless Maher Arar....

Nu inteleg totusi ratiunea unei citatii la divort prin toamna 2007, semnata de jud. Robert Condurat, dupa ce eu mi-am incheiat divortul in 10 nov. 2006, cu grefa finala, martor Gabriela Moraru, fosta martor-domnisoara de onoare in casatoria de pe 26 ian 2006…

Incep sa cred ca dupa esecul mariajul cu Simona Furtuna, am devenit un personaj de lichidat, de folosit doar in jocuri si schimburi politice, lipsit de orice drepturi ale omului, gen prizonierii Guantanamo, dar care automat “contamineaza”, produce probleme celor cu care intra in contact. Este o procedura win-win in avantajul celor care cultiva o societate de tip lumea a treia, Siria, Egipt... Sper sa ma insel, si sa fie doar un cosmar, o ipoteza absurda...
Daca este adevarata aceasta ipoteza de live bait, de probabila blocare si supunere la anumite investigatii, deci masuri de asa-zisa siguranta nationala. astfel de activitati de asa-zisa siguranta nationala pot acoperi usor abuzuri si jocuri... Stiu din Romania cum se "storceau" ceva sponsorizari de partid, dar nu cred ca este posibil asa ceva in Canada...
Daca insa functioneaza acest joc de siguranta nationala, atunci activitate unor firme, fundatii, persoane, asociatii, afaceri pot fi blocata complet pe 21 zile. Cu un astfel de joc, le poti bloca activitatea, posibil conturile...
Curios, acum are loc si bid-ul pentru Magna-Opel, contract cu mare miza europeana. Poate ca aici intra in joc anumite rivalitati intre producatorii nord-americani pentru piata rusa.
Ma gandesc ca in cele 3 luni de cand sunt in Canada am contactat, aplicat la firme gen Boeing, Bombardier, Air Canada, Research in Motion, Rogers, Bell, Fido, Bank of Nova Scotia, HSBC, RBC, Magna, cateva fundatii din Canada si Europa, cateva NGO-uri privind libertatea presei si drepturile omului, atunci este posibil sa le fi afectat oarecum activitatea, poate chiar sa le-o fi blocat complet daca sunt „fabricat” drept un suspect de cine stie ce. Suspectul de serviciu pica foarte bine sa acoperi abuzuri, sa elimini sansele de obtinere a unor compensatii in Justitie. Esti impins in gunoi, bagat si etichetat ca suspect, iar toate actele si drepturile civile ti se sterg. Exact acelasi lucru s-a facut in 1947 in Romania si Europa de Est...
Practic, te afli intr-un fel de canal de bob-sleigh, aluneci, esti impins pana la distrugere sau clacare, psihica, fizica, materiala. Eu am avut norocul sa fiu oarecum ajutat de un alt imigrant, un vietnamez, in job-ul de 9.50 CAD/ora, iar el aparent a cam trebuit sa plece din Canada, dupa cateva incidente poate mai putin intamplatoare... A gasit totusi un contract de predare a englezei prin China.
Ma gandesc ca ar putea pe undeva sa existe o legatura intre IMP, operatiunile ei FBO in Rusia, America de Nord si MP-ul de Halifax, actualul Ministru al Apararii canadian, Peter MacKay. Din ce am constat, de la intoarcerea mea din Calgary am fost oarecum sub "presiunea" military intelligence. Au existat acele manevre pe Marea Neagra in august-sept. 2007, au existat ceva zvonuri despre anumite unitati-container pt. razboi radio-electronic. Poate ca astfel s-au creat false podcast-uri BBC, poate ca din jocuri de genul asta a murit si gen. dr. Gheorghe, psihiatrul ingropat sub pietris... Sa fi actionat ca un patriot, sau ca un mercenar, dr. Gheorghe?
Pana la urma, din jocul asta s-au schimbat ceva procente in actionariatul SIF5, favorizand ceva achizitii de actiuni de catre Ford Romania Craiova...
A existat si seria de incidente in fotbal Bricheta-Valiza cu Bani, afectandu-l pe Becali, cu un cuantum de 2 mil. euro. Probabil asta era compensatia pe care trebuia sa o primeasca familia Bulacu, dar golanii din jur au facut tot posibilul sa se tiganeasca la plati. Becali face parte din sistemul imobiliar al lui Victor Babiuc, cu posibilele afaceri de tigari Tigareta 1, 2, 3 etc, contrapartidele pentru armamentul de Dragasani, sau poate recuperarea creantelor gen Angola de catre Iosif Armas sau altii ca el.


Aparent afacerile astea au fost cumva coordonate de SPP-ul in care este si cunoscutul meu Liviu Maria. Poate ca el sa fi fost la curent cu actele mele pentru Bout, desi nu sunt convins. Cred ca SPP-ul face cumva politica de cadre intr-o masura in Romania, in politica. Ma intreb daca nu cumva situatia - provocarea Florian Lesch din iunie 2006 nu a fost cumva o "palma sub fund" pusa Elenei Udrea, si posibil un atac asupra unui grup Casini, sau poate Dimitri Kececioglu. Probabil aceasta urcare, agresiune, avansare a Elenei Udrea a inceput cu situatia Lesch, urmata apoi de plecarea lui Omar Hayssam, iar poate ca posibilul malware din Acer-ul meu din nov-feb 2006-2007 a fost in aceasta linie, dar nu am certitudini.


In mod cert, privind in perspectiva, cred ca mare parte din ceea ce s-a intamplat a inceput din 1995-1996 in Montreal cu Rona Dulbergher si Iorgu Banica. Posibil ca exista pe undeva o mica imixtiune sau o conexiune prin Las Vegas, de unde a aparut Lia Roberts, ca si candidata prezidentiala. Poate ca dr. Ionica Alexia si Lili sa fie cumva la curent, si cert in ceva legaturi cu SIF 5. Cred ca plecarea mea de la Boeing, dupa furtul portofelului in magazinul Edy Bauer din Everett, la FLS Aerospace care era contractor pentru TAROM, poate ca are o legatura si cu min. transporturilor de atunci, Radu Berceanu.
Contabila mea din Romania, si fosta iubita, Vera Tucu, i-a fost eleva, l-a avut ca diriginte pe Radu. Se pare ca exista legaturi intre Radu Berceanu, Phil Bloom, Dinu Patriciu si asociatul acestuia Phil Stevenson.
La scurt timp dupa intoarcerea in tara a existat furtul sau disparitia certificatului de nastere, in vara 1998. Situatia s-a concretizat insa probabil in mai - iunie 2007 in Calgary, unde mi s-a inlocuit in safe deposit box la CIBC Downtown cu un duplicat MIHAIL. Probabil atunci se intrase pe un scenariu de eliminare a mea, sau de destabilizare, probabil pe linia Informatii Militare.
Rezultatul este vizibil prin demisia sapt. trecuta a lui Ken sau Tim Robinson, directorul Military Intelligence Canada, poate la paritate cu gen. Croitoru, demis dupa furtul Browning-urilor de la Ciorogarla, si a celorlalte automate.
Cred ca pe undeva a existat o cauza care a dus la cesiunea in mai 2002 a VFS Romania SRL catre Maria Nisipasu la sotia MEP Marian Jean Marinescu, desi nu vad care era motivul sa fim pusi in fata, eu, dna notar si dna Nisipasu... Poate doar ca era sotia lui MJM, in viitor, iar eu aveam in acel moment ca act de identitate pasaportul CRDS...

Probabil se pregatea un comitet de custodie psihiatrica, poate din cauza asta a aparut un alt dosar de divort pe citatia semnata de jud. Robert Condurat in nov 2007... Care sa fie jocul aici? Cred ca trebuie sa legalizez decizia grefata din 10 nov 2006, sa fiu sigur.


Cred ca autorul jocurilor psihiatrice din Toronto era dr. Samuel Malcolmson, de 71 ani. De fapt, se urmarea o introducere pe un canal de scripturi, turnator, sifon, sau bodyguard. A federal judge says national security laws are not intended to shield intelligence agencies from embarrassment.

In his reasons for delivering a key ruling in the Maher Arar affair, Mr. Justice Simon Noel of Federal Court said there is a “genuine public interest” in openly dealing with the subject of torture of detainees, and the use of information gathered through force.

“Protection from embarrassment is not covered in our security laws,” Judge Noel wrote.

The long-awaited reasons for a judgment handed down almost two years ago explain why the judge approved release of disputed sections of a 2006 inquiry report into the overseas torture of Mr. Arar, an Ottawa electronics engineer.

In the same vein, the delay in publication of Judge Noel's reasons resulted from lengthy deliberations over what portions of his top-secret explanation could be disclosed. Portions of the judge's July, 2007, reasons remain blacked out.

It's the latest chapter in the long-running saga of Mr. Arar, a Syrian-born Canadian who was detained at a New York airport in September of 2002 and subsequently bundled aboard a private jet by U.S. authorities. He was flown to Jordan and driven across the border to Damascus, ending up in a crypt-like cell where he gave false confessions under torture about terrorist links.

An inquiry led by Mr. Justice Dennis O'Connor concluded in September of 2006 that the RCMP passed misleading, inaccurate and unfair information to the Americans that very likely led to Mr. Arar's arrest and transfer to Syria.

In early 2007 the Canadian government apologized to Mr. Arar and gave him $10.5-million in compensation.

Months later, as a result of Judge Noel's ruling, additional passages of Judge O'Connor's report became public over the objections of federal lawyers who argued their release could damage national security, international relations or the defence of Canada.

The new elements revealed that Canada's spy agency suspected, within two days of Mr. Arar's deportation, that the U.S. Central Intelligence Agency had shipped him somewhere to face possible torture.

The suspicion within the Canadian Security Intelligence Service was fuelled by knowledge of a pattern of cases in which American authorities would send terrorism suspects abroad for questioning in countries that paid little attention to legal niceties.

Jack Hooper, then deputy director of CSIS, said in an Oct. 10, 2002, memo: “I think the U.S. would like to get Arar to Jordan where they can have their way with him.”

In his reasons released Thursday, Judge Noel said he was not persuaded that disclosing Mr. Hooper's comments would harm Canada's interests with the United States.

“Such disclosure might upset some officials but any reasonable person must admit that such a statement reflects the realities of the time. It might embarrass some, but again, such embarrassment in itself does not constitute injury.

“There is a legitimate public interest to inform the public of such knowledge within CSIS, in order to be able to assess the work done by the agency at the time.”

Judge Noel ruled that some disputed information, including passages of Judge O'Connor's report referring to CSIS's knowledge and assessment of Mr. Arar, should remain secret.

However, because of Judge Noel's judgment it also emerged that Judge O'Connor found the RCMP used information from an unnamed country to help obtain search warrants against several people in January of 2002, part of a broader anti-terrorist investigation in Canada.

The Mounties didn't tell the judge who issued the warrants the country had a questionable human rights record, and undertook no analysis of their own to determine if the information had been obtained under torture.

Judge O'Connor also concluded the RCMP again included suspect evidence in an application for a wiretap warrant in September of 2002. The information came from an alleged confession by Ahmad El Maati, another Arab-Canadian who was interrogated in Damascus but later disavowed his statements, saying they were extracted under torture.

Kerry Pither, a human-rights advocate who has written about the incidents, said Judge Noel's reasons underscore that Canadian agencies made “a mockery” of the sometimes legitimate need for confidentiality of national security matters.

“They tried and tried and used it as much as they possibly could to shield themselves from public embarrassment.”

It's not the first time Judge Noel has sharply warned security officials against undue secrecy.

The judge made waves recently in the case of Mohamed Harkat, who faces deportation on a national security certificate. Noel expressed grave concerns about CSIS's failure to disclose important evidence about the reliability of an informant to the court.

As a result, hearings to determine the validity of the case against Mr. Harkat have been delayed for months.

Mr. Arar continues to wage a legal fight for redress in the American courts.

A separate federal inquiry headed by Mr. Justice Frank Iacobucci, a former Supreme Court judge, looked into the imprisonment of Mr. El Maati and two other Arab-Canadian men in the post-9-11 period.

In his October, 2008, report, Judge Iacobucci said Canadian officials shared responsibility for the torture of Mr. El Maati, Abdullah Almalki and Muayyed Nureddin in Syria through the sharing of information with foreign intelligence and police agencies.

The three men are seeking apologies and compensation.
